When you compare the Justice system around the world through punishment, structure, and religion it is typically called comparative justice. There are four legal traditions that most countries work with such as common law, which derived from the British Empire. Common law is still in areas of current or former British territories. The second legal tradition is civil law, which originates in Europe, and is still used in America’s state of Louisiana, and Canada’s Quebec. Even though Canada & the U. S’s countries are still mostly using common law. The socialist law is used frequently in communist countries such as Russia, and China. The first nation deals with the civil laws, which is called the German courts. Germany has the oldest legal family in legal traditions. Laws are binding to them because they are authorized and recorded by the authority. Canadian’s court mostly follows the common law just like America, because Canada is still under British rule. Britain created Common law, so it makes sense for Canada to follow Britain’s footsteps. There is one province called Quebec in Canada that is still under civil law, because France still had great influence. Saudi Arabians Courts use the law of Shari ‘a, which is the path to follow. This law consists of Qur’an, which means Islam’s holy book, and Sunna, which means the statements and deeds of Muhammad. They find crimes and punishments through these, but provide very little information on punishments. Three category of crime in Shari ‘a is Hundud, qusas, ta’azir. Hindu’s requires mandatory prosecution, qusas is less serious of a crime compared to hundud, and ta’azir is the least criminal. Islamic law is more religious then simply judicial, because it incorporates law with religion, and that false swears will suffer consequences of judgement day.
