Comparing Michigan's Judicial System

I have chosen to compare Michigan?s judicial system with ours for this assignment. Missouri?s judicial system consists of three levels, the Circuit Court (trial court) which is the lowest level of the system, then the intermediate appellate courts which is known as the Court of Appeals and then the highest level of our judicial system, the Missouri Supreme Court, or the ?court of last resort.? Missouri?s Circuit Court contains 45 circuits with courts in each county that includes 134 circuit judges, 175 Associate Circuit Judges and 336 Municipal judges. The Circuit Courts include divisions, such as probate, juvenile, municipal, associate, family and circuit divisions. Witnesses and juries are only used in Circuit Court cases. There are also no juries or witnesses and it involves only lawyers from both sides that argue the law and answer any questions the judges may have. There are seven judges at this level or one Chief Justice and six judges on the panel. The Chief Justice is elected by the court?s sitting judges and is elected a two-year term. Cases can be appealed to the Supreme Court that were heard in the Circuit Courts or the Court of Appeals and the Supreme Court can override those courts decisions. The Supreme Court?s role is to guarantee a firm and reasonable judicial system and is the final arbitrator in disagreements that involve the state?s constitution and laws. The Supreme Court hears the most contentious legal issues that involve Missourians, businesses or even sections of the government. The voters of Missouri approved changes in the Missouri Constitution so that the Supreme Court has sole jurisdiction in five kinds of cases that are appealed to them and these are, the legitimacy of a U.S. or Missouri statute, the state?s revenue laws, any challenges to a state elected official?s right to possess an office, and to enforce the death penalty. The Chief Justice is elected every two years by the court. Missouri Supreme Court judges serve twelve year terms. The Missouri Supreme Court panel consists of one Chief Justice and six judges. Some differences I found was the qualifications to be elected a judge in both states. In Missouri, Circuit Court judge must be at least 30 years old, registered voter in the state for three years before the election, U.S. citizen at least ten years, licensed to practice law in Missouri and live in the district of the circuit the judge serves for at least one year. Michigan District Court judges must be a qualified elector of the district, licensed to practice law in Michigan with at least five years law experience in law and under the age of 70. Missouri?s Court of Appeals judge qualifications is licensed to practice law in the state, U.S. citizen for at least fifteen years, registered voter for at least nine years, at least 30 years old and at most 70 years old, and a resident of the district being elected for.
