When anticipating the death penalty jurors may be less inclined to convict defendants and sentence them to the death penalty. Minority defendants have shown to be treated more punitively. Should the judge or jury decide who is sentenced to death? Over the last decade, the death penalty decision from jury to judge has increased the number of death sentences. One of the many reasons the jury to judge decision has increased the death penalty is because the jury has more sympathy. They do not want to sentence someone who may or may not be guilty to death. The judge has less sympathy they can tell if people are lying. They are more likely to be able to tell if someone is guilty, so they don't have as much sympathy. Because of the horrible things people do, the death penalty should be legal if the crime is punishable by death. A crime is determined punishable by death if it is determined the crime deserves capital punishment.
