8. What are the pros and cons concerning regulation of the profession? There are pros and cons to the argument of regulating the paralegal profession. For every argument for regulation there is an argument against regulation.
No federal regulation of safety and no enforcement of state or
OSHA thinks differently and action is going to happen if they do not manage precisely to OSHA’s
According to President Ronald Reagan, the 40th U.S. President (1981-1989), the gov-ernment should be highly accountable to its citizens, particularly when it comes to the spending of tax dollars. Reagan clearly expresses a critical perspective towards the role of the United States government in that excessive spending has been a significant problem. Reagan upholds a perspective of a classical liberalist in the way he criticizes the nature of the welfare state – one that is flawed when citizens lack incentive to work hard in achieving self-sufficiency and rely heavily on government support. That is, Reagan openly states a concern regarding fiscal and monetary policies where the government is spending possibly more than
A New York Times article examines the changing of EPA regulations regarding toxic chemicals. Despite scientists warning that certain chemicals cause birth defects, cancer, and other health issues, the EPA has made it harder to evaluate the effects of these chemicals and thus regulate them. The deregulation has been spearheaded by a representative of the chemical industry, who now holds a high position in the EPA. The decision to deregulate chemicals that pose a danger to the public is a prime example of the trend that government increasingly caters to powerful interests.
That so interesting to hear and I think that since our founding of the nation, the Constitution can be referred to ask the "bible" of this country. The Founding Fathers worked so hard to be independent and create a nation that was different, but one that could work for many centuries. After two centuries and five decades it has seemed to work and it would be very hard to change something that so many of us are used, too. There are times when it may seem that our system is failing, much of the public doesn't blame the system when things go wrong, we tend to blame those who are in office or Congress. What makes our governmental system so different and unique is that people are more willing to go vote for the president and want their voice to
Out of these four, the most important of these is a failure by the contractor to take "effective steps to achieve practical application of the subject invention" or a failure to satisfy "health and safety needs" of consumers. Apart from public safety issues, government may exercise this on:- 1) Small business or non-profit which are funded by
Kerwin provides the example of the Occupational Safety and Health Act of 1970 in order to illustrate the effects of half-baked rules/regulations. OSHA had been granted the ability to adopt “consensus nation standards” without regard for the rulemaking standards of the APA. The resulting rules were “met with cascades of criticism, outrage, and worse – ridicule.” The absence of professionalism in this relaxed rulemaking situation helped expose issues with expedient/limited rulemaking. In the case of OSHA, their willingness to disregard the inherent complexity of their regulations led to less than desirable
As I reviewed our class power PowerPoint on Urban services and literature about the pros and cons of privatization of public services. The groups I was in discussed the pros and cons of privatization and we seemed to all have different ideas of what public services should be. We also discussed the need for certain services in a city the size of San Antonio and what the goals were for having these urban delivery services. I personally believe, there could be a privatization of transportation services but I am on the fence of whether solid waste management and water and sanitation should be deemed private.
The presence of security services in democratic nations offers ascent to a political conundrum. From one perspective, the security services are established so as to secure the state, its citizens and the democratic order and they are given special powers and capacities for this reason. On the other hand, by virtue of their special powers and capacities they have the potential to undermine the security of citizens, debilitate the state and subvert the democratic process. Keeping in mind the objective of turning away these dangers, the security services are subject to a scope of controls and different forms of oversight. The intelligence services present a particular challenge because of the way they function, their intrusive powers and their
I would advise to accept the promotion. Even though taking this promotion would bump him up to the next tax bracket, I would reassure my friend that because our tax code is marginalized, “you’ll never take home less than you earn” (Video Engager, 2016). A marginalized tax code guarantees that you only pay income tax on the amount of money that you make above the tax bracket that you are in. this assures that you will not take home less income because of a higher tax bracket.
The safety belt law forces an administrative direction that can, at most, be held to ensure just the individual subject whose conduct is being limited. Why should the government be able to tell an individual what to do in the privacy of his or her vehicle? Being someone who was born in the United States I have always had freedoms that I understand not everyone in the world are offered these same rights as a citizen in their particular country. The United States has been labeled among other things the land of the free by the rest of the world. This is because we have the right to start businesses, buy or sell consumer goods, pretty much anything that we like.
Railroads are extremely dangerous. In a video called “It is Your Choice” it explains that the supreme court has ruled that trains have the right of way at all times. The vehicle or pedestrian is responsible for yielding to the train. The same video states that each year more than 1,000 people die in railroad crossings or railroad rights of way and several thousand more are injured. School buses and trucks carrying hazardous materials are required to stop at all railroad crossings.
To be free is defined as the condition or right of being able or allowed to do whatever you want to, without being controlled or limited. In today’s society freedom can allow you to a variety of things. To be safe is defined as the condition of being protected from or unlikely to cause danger or risk. In my opinion safety is more important than freedom. Freedom is something that can be offered anywhere.
A well-timed New York Times story says amusement park safety mishaps “raise the question of whether roller coasters and other thrill rides, which are faster, taller and more extreme than ever, have also become more dangerous.” The piece ran Sunday and was filed before Saturday’s incident at Cedar Point, in which two guests were injured in an accident on the Skyhawk ride. It begins by noting recent accidents at Six Flags parks in California and Texas, as well as an accident last summer on Cedar Point’s Shoot the Rapids water ride, where a boat rolled backward and flipped over, injuring at least six people.
