The public defense system is negatively affecting indigent criminal defendants who cannot afford an attorney. The Public Defender's office states that many of these attorneys have insufficient resources and inadequate oversight, which makes it difficult for attorneys to represent these criminal defendants. Due to the fact that there are limited resources available for indigent criminal defendants, many will suffer injustice at the hands of the attorneys who are supposed to ensure defendants’ constitutional rights to a fair trial, and to due process and equal protection under the law.
