The Individuals with Disabilities Education Act (IDEA) ensures that all children with disabilities have specified legal protections and receive a free and appropriate public education. In compliance with IDEA, there are 13 recognized disability categories, the disability of interest for this paper is Emotional Disturbance. States are one entity to benefit from IDEA; financial funds are allocated to states upholding the rules and regulations of IDEA. This paper will examine how the state of Wisconsin implements the Emotional Disturbance (ED) disability category of IDEA.

EBD is defined as social, emotional, or behavioral functioning that departs from generally accepted, age appropriate ethnic or cultural norms; that adversely affects a child’s academic progress, social relationships, personal adjustments, classroom adjustment, self-care and vocational skills. The child should demonstrate serve, chronic and frequent behavior that is not the result of situational anxiety, stress, or conflict. The child’s behavior occurs in school and at least one other setting. The child should also display one of the following: (A) Inability to develop or maintain satisfactory interpersonal relationships. (B) Inappropriate affective or behavioral response to a normal situation. (C) Pervasive unhappiness, depression, anxiety. (D) Physical symptoms, pains, fears associated with personal or school problems. (E) Inability to learn that cannot be explained by intellectual, sensory or health factors. (F) Extreme withdrawal from social interactions. (G) Extreme aggressiveness for a long period of time. The IDEA disability category of ED is referred to as EBD in the State of Wisconsin. The criterion to be diagnosed with EBD is much more focused than ED. EDB specifies that the disturbance must be due to social, emotional, or behavioral that differs from the age appropriateness and ethic or cultural norms. ED does not give specific details as to what the disturbance should look like. EBD also specifies that the child’s behavior must occur in at least one other setting than school, ED does not outline any details about the location.
