As hard as it is to admit, the American justice system is flawed. The documentary Broken on All Sides explores some of the problems the American justice system has. Some of these problems include mass incarceration in America and racial injustice. This documentary begins with the discussion of the drug war which led to a massive increase of incarnated citizens in America following this was the discussion of the brutality and discrimination African Americans face when it comes to the American justice system. While still bouncing off those two main topics, the documentary begins to discuss about what life is like inside jails/prions and the problems former felons deal with once released from prison.
Currently, the United States holds 5% of the world’s population, but 25% of the world’s prisoners (eji.org), which comes out to around 2.3 million inmates. 10,000 of these prisoners are children housed in adult facilities. 20,000 of these prisoners are wrongly convicted of crimes they did not commit (huff post). 356,000 are seriously mentally ill (treatment advocacy). One million of these convicts are African Americans (NAACP).
Not only does Berstein call for an overall reform of this nation’s juvenile prisons, she goes as far as saying the practice of locking up youth is in need of a “more profound than incremental and partial reform” (13). The fact that Bernstein outlines the numerous failed strategies and goals of this practice with her compelling use of studies and statistics is enough to promote an audience to reject the practice of locking up youth. The statistic she shares that “four out of five juvenile parolees [will be] back behind bars within three years of release” as well as the studies she conducted on numerous instances when a guards abuse of power lead to the death of a child work to further prove her point: being that “institution[s] as intrinsically destructive as the juvenile prison” have no place in a modern society (13, 83). Bernstein refutes this false sense effectiveness further by sharing her own ideas on what she believes works as a much more humane solution to rehabilitating
The documentary film, The Central Park Five, demonstrate the result of people's tendencies to generalize individuals due to their racial group and their economic standing. In this case, five teenage boys were wilding in central park accompanying a group of other boys but the five boys were arrested and then later was suspected of another crime that also takes place at the park that night. They were accused rape of a woman jogging in the park and they gave false confessions to those claims. Come the time of the court hearing, these five teenage boys were already known to the public as a dangerous group. They were found guilty of a crime that they did not commit.
Since, the majority of African-Americans live in areas of drug involvement, they are more likely to be racially profiled and investigated. This has created an uneven ethnic ratio in prisons and produced stereotypes that affect children that prevent them from becoming abiding citizens.
Tim Burton’s film, Edward Scissorhands, has a significant amount of interesting scenes including the captivating scene where Edward is joining the family for dinner along with two of Kim’s friends. Even though this scene only has the duration of about a minute, it has perfect use of a compatible dialogue, props and, numerous different camera angles, that all combine and enhance the the scene. This scene was put here to insure the audience understands a following scene. The props, in most movies, are not focused on very often, and usually ignored. However, in this scene the props are shown a significant amount.

“African Americans now constitute nearly 1 million of the total 2.3 million incarcerated population.” The majority group of this statistic are people who come from african american backgrounds. The fact that black people are to make up nearly half of the prison population alone, really conveys the rate at which they are being arrested. Black men are often victims of racial profiling by police. They are targeted by police officers, and security guards, and are accused of crimes unrelated to them, simply on the basis of their skin color.
Today we have between 200,000 and 250,000 children below the age of 18 being charged as an adult every year in the United States. What’s important to note, is that the racial gap in arrest rates is even larger for teens than adults as kids of color are disproportionately affected. Willie has spent the last 30 years in isolation and as a 54 year old man he has nothing to look forward to but the same. He has claimed to have committed over 2,000 crimes and while his original crimes only netted him 5 years of incarceration, he soon proved unable to live in society by assaulting a 72 year old man soon after his initial release. Once in jail again he stabbed a guard and was sentenced to 25 years to life.
The article, The Steep Costs of Keeping Juveniles in Adult Prisons by Jessica Lahey states that “due to the imbalance of power between children and adults, not to mention between children and prison staff, sexual abuse of juveniles in adult prison is underreported; fewer than one in 10 of the juveniles surveyed reported their abuse.” ( ). The adult prison is not safe because of the abuses between the staff and juvenile, they need to be aware of what happens in the adult system. Lahey wants to show how dangerous the adult system is by stating what actually happens in prison to the juveniles because of the adult prisoners and the staff. Lahey also explains about how the lack of services and safety, “juveniles housed in adult prisons are 36 times more likely to commit suicide than juveniles housed apart from adult offenders.”
Nevertheless, millions of African Americans still live mired in poverty, susceptible to poor living conditions in underserved inner cities. The War on Drugs, which began in the 1980s, is a leading cause of the high rate of incarceration among African Americans, especially males. Today, criminal gangs have spread throughout the country and into the prisons. The United States has the highest incarceration rate in the world, with over 1.6 million dwelling in prisons. Of this number, a fairly large amount are African Americans.
There are many children in the world who are being put behind bars and detained for alleged wrongdoing without protections they are entitled to. Throughout the world, children are charged and sentenced for actions that should not be considered as adult crimes. Here in the United States, the minimum age of criminal responsibility is age 12. Law enforcement officials and those in the juvenile justice system nationwide tend to mistreat underage individuals by trying cases while working through the lens of an adult. Unfair punishments are still handed down domestically, which is in violation of Supreme Court law.
Doing so has had countless adverse effects on the youth. Despite this, many prisons and facilities have turned a blind eye to these negative factors, and continue to plant them in the adult systems. Children should not have to be put in jails and prisons with adults because they have an increased chance of being raped, educational services are often too expensive, and their minds are inclined to becoming mentally unstable, which often leads to suicide. Solutions to these issues include lifting the ban that prevents grants to be awarded to inmates, and abolishing children from adult jail facilities altogether. Conversely, others may argue that these children deserve this treatment, children are becoming more intelligent and know right from wrong, and that these sentences will show others what can potentially happen.
Can you imagine waking up behind closed walls and bars? Waking up to see your inmate who is a 45-year-old bank robber and you are a 14-year-old minor who made a big mistake. This is why minors who have committed crimes should not be treated the same as adults. Some reasons are because the consequences given to minors in adult court would impact a minor’s life in a negative way. If a minor is tried through a juvenile court, they have a greater chance of rehabilitation.
