The Australian Consumer Law (ACL) sets strict legal guidelines that all business must abide to. The ACL is enforced and administered by the Australian Competition and Consumer Commission (ACCC), as well as State and territory agencies (Australian Consumer Law 2016). The ACCC ensures that the advertising of a product is not misleading or deceptive to the consumer (Class Notes, 2016). As well as the ACL and ACCC, the telecommunications (Customer Service Guarantee) Standard 2011 is enforced upon Foxtel, requiring that they meet minimum performance standards (Foxtel 2016). Between movies Foxtel advertises its own services, promoting its on demand service. When they are advertising they need to ensure that the content they show is within the Broadcasting Services Act of 1992. This regulates matters that are advertised such as tobacco and therapeutic goods advertisement, sponsorship announcements and community TV. The Australian Communications and Media Authority enforces that fast food ads shown on children’s channels, must focus on the food and not the gift with purchase. When advertising Foxtel must ensure that all images are sourced from Foxtel, as well as correctly outlining prices and additional costs.
Ethical Considerations are those that are not wrongful of the law; however community members may perceive it as not being the correct thing. Foxtel is often accused of misrepresenting whilst advertising. They advertise a specific package to be priced at $20 (e.g. the movies package).
