Abstract: Human rights are moral principles or norms that describe certain standards of human behavior, and are regularly protected as legal rights in municipal and international law (Nickel, 2010). Charles Beitz (2009) has indicated that “if the public discourse of peacetime global society can be said to have a common moral language, it is that of human rights.” Human rights are sometimes a country’s weapon to attack one another. Since the 1990s, the issues of human rights become the vital factor that trouble the relationship between America and China. It is one of the roots of the conflict of between them.

More importantly, America is the only superpower on this planet. Material determines consciousness. The prosperity of the American economy needs the atmosphere of democracy and freedom. In the American Constitution, citizens can legally possess guns to protect their safety and property. They believe that it embodies democracy and freedom. However, one can’t deny that the gun control issue has been popular in recent years since it causes lots of death to the innocents or the students in school. The Chinese think that the most important things in human rights are survival and development rights. Without the survival and development rights, it is unrealistic to prate about democracy and freedom, especially for developing countries. China doesn’t oppose to develop its freedom and democracy such as proposing “one man one vote” in Hong kong, but currently, the priority of China is the survival and development
