In 1864 Congress approved the Northern Pacific Railway to be built. The NPR is the first transcontinental railroad in the northern part of the country. It is 8,316 miles long, beginning in Minnesota and ending in Washington state, with many branches going off the main line. When congress approved it they also supplied nearly 40million acres of land grants to build the railroad on. Construction didn 't go underway until 1870, and the rail road was finally christened to open on Sept. 8 1888.

To conclude, according to Nathaniel Belanger statement in court the accident could not be prevented. But it did not seem to hold up because there was no evidence to prove his story. The court took sides with Swift Transportation Incorporation because they felt that Swift did not slander Belanger and had every right to report the accident on the Data Website. However, the evidence shows that Complainant was told that he was unable return to the Bureau of Operations because he had not reached the maximum medical improvement for the injury to his retina in his left eye. By Complainant’s own admission as of June 2015, he was still undergoing treatment for a partially detached retina and had not reached his maximum medical improvement for his left eye. Further, Complainant acknowledges that he was told by Respondent’s Medical Director the reason he could not return to the Bureau of Operations was the concern about him performing emergency response driving which is an essential job function. Although Complainant’s physician gave him medical clearance to return to work without any restrictions, Respondent’s Medical Director told Complainant that he could perform all tasks except the emergency response driving.
