DWI If Not Driving
Most people believe that they cannot be arrested for Driving While Intoxicated (DWI) if they are not driving. This seems logical from their point of view since they are really not driving even if they are intoxicated. However, as per the laws in Kansas City, MO, there is a definite possibility that you may be arrested for DWI even if you are not driving.
The law may not be all that clear but the fact is that your vehicle does not have to be moving or even running for a DWI arrest. As long as the driver is in the car and is believed to be the one in control of the car, they can be held liable for irresponsible behavior such as being drunk or under the influence of drugs.

If you are drunk or intoxicated, just take a cab home. Why risk sitting in your car anyway? If you are stopped, there is always a chance that the officer in question may smell the alcohol. They could also figure out your physical condition by the way you speak to them or whether you are able to maintain eye contact. If your speech is slurred and if your eyes are bloodshot, this is a dead giveaway that you are drunk. The officer can then ask you to take a breath test and/or sobriety test. If you are above the minimum levels, you will be arrested.
There is no excuse for driving while drunk or intoxicated. There is also no excuse just sitting in your car while you are not hundred percent fit. If you have access to a car and you have the car keys on you, there will always be a risk that you would decide to drive. The laws are designed to ensure that doesn't happen and that is why you can be arrested for a DWI in a parked car.
