IDEA regulations encourage positive behavioral intervention and support for students with disabilities. In 1997, amendments were made to the Individuals with Disabilities Education Act to ensure that students with disabilities had IEP’s that addressed behavioral issues which prevented them from reaping the benefit of learning opportunities, and to also ensure that they were treated fairly for behavioral issues. The changes included considerations of safety issues when a student poses a threat to him or herself and/or others. The changes allow for a range of actions from alternative placement and IEP modifications, to removal by hearing.

The answer to this question for Stacy is no, which means she will be able to stay in her general education classroom, which will ultimately benefit her. Among the 6 principles of IDEA, I believe that “providing appropriate evaluation” is the one that affect the most my role as a special educator. My choice is mostly because I have some considerations about the legal requirements established to assess students allocated in special education services. First of all, the goal of special education is to enable students with disabilities achieve the learning goals that are established for the typically developed students, as stated by the “No child left behind act” (2002). That would only be possible if the teachers fill the gap between the student’s capabilities and the standardized tests expectations.
