More offenders are being detained with illegal drugs in their system, with most being repeat offenders. This observation is the reason behind this proposal. Providing an overview of criminal addicts and the rate of drug offending in Australia and South Australia. The Drug court in S.A. will be analysed before introducing New South Wales Compulsory Drug Treatment Program. Strengths and weakness of this program will be discussed. The penological principles of rehabilitation and incarceration will be discussed as reasons for the development of these two policies. A recommendation will then be made to include aspects of the New South Wales program as a sentencing option by the South Australian Drug Court for chronic drug offenders.

To resolve consistent repeat offending NSW brought in a compulsory drug treatment program (CDTP) which was the first of its kind in Australia and incorporates aspects of the Netherlands and Unite States programs. CDTP was also established because illicit drugs still seemed to enter prisons and counteracting the success of drug treatment programs within prisons (Birgden, 2008; Birgden & Grant, 2010). With the main aim of the programs is to change offenders behaviour and reduce the risk of them reoffending (SA drug court, 2012; Birgden, 2008; Birgden & Grant, 2010). Programs also use the principle incapacitation with the SA drug court using home detention and CDTP using fulltime custody being the first stage (SA drug court, 2012 Birgden 2008; Bull, 2006). Incapacitation prevents offender from reoffend through restricting their movements (Bull, 2006). Used within rehabilitation it removes offenders from temptations from the outside world which increases their change of recovering.
