In addressing respect for human dignity, the Belmont Report (1979) incorporates two ethical convictions: first, “individuals should be treated as autonomous agents, and second, that persons with diminished autonomy are entitled to protection.” (p. 5). The prisoner’s rights movement is mostly recognized for the events that occurred through the 1960s until the 1980s but it is important to review cases beforehand that led up to the movement itself. In the case of Pervear v. Massachusetts of 1866 a case was fought through the Supreme Court. The court ruled that prisoners should have no constitutional rights, which concluded the Eighth Amendment did not apply to them. The Eighth Amendment states “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted” (US Const. Amend XIII).
On November 11th 2015, Duke University’s Prison Network Series brought Lisa Gunther to discuss the 2013 California Prison Hunger Strikes. The event titled ‘A Critical Phenomenology of Solidarity & Resistance in the 2013 California Prison Hunger Strikes’ focused on the theory and structure of solitary confinement, how it affected the inmates confined and the hunger strikes that resulted. This essay will include a brief description of Lisa Gunther ’s talk and a particular focus on the areas that I found most stimulating and relevant to my AAAS course. Gunther commenced her talk with the background of solitary confinement in the Pelican Bay State Prison.

The amount of mass incarceration in the United States as reached an all time high over the years. Mass Incarceration is the incarceration of a person or race based off of them being different and can be identified as a trend among law enforcements. These tensions have reached a certain extent and has received the attention of American citizens and the nation’s government. The laws of the United States seems fair, however with the enforcement of these laws, specific groups are targeted and abused by them daily.
First of all, I would like to introduce what social justice means to me. Social justice doesn’t mean just equality, but justice or equity. Nobody is the same and some people need more help than others. For example, there is one person who is left handed and one right handed. Moreover, it also helps society to maintain security since a just society can abolish conflicts among people.
