Crime Description This paper will analyze the murder of Vanessa Pham by Julio Miguel Blanco-Garcia. Around 3:30 in the afternoon on June 27, 2010, as Vanessa Pham was leaving a nail salon in Fairfax Plaza Shopping Center when Julio Blanco-Garcia approached her. Blanco-Garcia, high on PCP and carrying his infant daughter, told Pham that he was having a medical emergency and asked her to drive him to the hospital. Vanessa agreed and allowed the two into her car.
This case is about when a man named Stanley ‘Tookie’ Williams tried to gain executive clemency from the governor of California, Arnold Schwarzenegger. In 1971 the Supreme Court had to decide if states could give money to certain religious based schools to hire staff even if the teachers couldn’t teach religious classes. The first amendment to the Constitution established the law of separation of church and state. What is the established boundary between church and state? This case would be the defining point in that fight between the involvement of a state and the churches.
The Supreme Court came back with a decision six months later with a 5-4 decision. This meant that 5 judges were for the death penalty and 4 were against. Justices Douglass, Brennan, Stewart, White and Marshal all concurred that executing Furman was wrong. Justices Burger, Blackmun, Powell, and Rehnquist all voted that the execution was the correct action to take against Furman. The court’s decision was that giving Furman the death penalty was cruel and unusual and in clear violation of the constitution.
Even though there was evidence that tipped off that the murder was in fact unintentional, Furman was sentenced to death by electrocution in the state of Georgia. Furman did appeal to both the sentence and conviction, and the Georgia Supreme Court endorsed both on April 24th, 1969. But on the 3rd of May, the court delayed Furman’s execution so that Furman could have a chance to appeal to the U.S. Supreme Court.
