History of the First Amendment:
The First Amendment and the Bill of Rights – was not within in the Constitution when it was written in 1787. The Bill of Rights was passed by Congress, approved by the states and went into effect December 1791. When the Bill of Rights and larger Constitution, only applied to white propertied males. Only protected actions by the federal government. State governments could – and did – limit freedom of expression and religion, and other rights. It took till 1925 for the Supreme Court to start to apply the First Amendment to the states.
