MASQUERADING TORTURE AS SUICIDE A 32 year old male prisoner’s autopsy report revealed that he who was alleged to have committed suicide was really undergoing torture. The injury noted over the back of abdomen signposts that he was tortured after his crime. And that prisoner was kept in custody for chain snatching. R. Sankarasubbu, counsel in the Ram kumar case, says “Even if we believe it was suicide, why were these objects accessible to the prisoner? Apart from this, why was the undertrial put in this high security zone and segregated like this? It has become a known fact that rich shall have preferential treatment in prison .Rich and political offenders are showered with many privileges like TV, separate fan, clean mattresses etc. They are even given separate clean bathrooms and latrines. Reasonable classification based on the gravity of offense committed is not made instead status decides the preferential treatment. Even sometimes good food from outside is provided to the rich offenders. It creates a wrong idea that the rich can make as much as crimes they want and enjoy a lavish lifestyle in prison. The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth says Article 14.It is clear violation of Right to equality. A person who has no record of crime and a crime which he committed is of less impact then he shall be given a preferential treatment as it can be considered a reasonable classification and at the same time be given an opportunity to reform himself.
