If a young person is aged 17 years and six months or younger, then the case can be remitted back to the Children’s Hearing for advice and/or disposal (where appropriate to do so). The young person does not require to be subject to a Supervision Requirement through the Children’s Hearing System, or known to the System. If a Henry was already subject to a supervision requirement he would be assessed to determine if at risk of a custodial sentence, then the report writer would consider whether a secure unit rather than prison was appropriate.
