Further documentation shows that Sandusky had not only one sexual relations with a student; but with “10 boys in a period of 15 years. “(Huffington Post) The classification of crimes that Jerry Sandusky committed is legally defined as “mala in se.” During the first apparent observation of abuse occurring at the school, Michael McQueary, a former assistant coach for Penn State, reported the descry to Joe Paterno; whom then reported the accusation to school officials.
Here, Jerry Sandusky was an assistant coach at Penn State for years, under the leadership of Joe Paterno the founder of Second Mile. This organization helps disadvantaged children. Jerry seems to be a model citizen within the community. Jerry Sandusky was a serial child rapist, it’s hard to understand that no one knew of his insignificant behavior. Furthermore, in Penn State University there were people in high place that know about Sandusky behavior and did nothing.
Sandusky started off by just touching the young boy. Eventually forcing him to engage in anal and oral sex. Once the boy turned 16, he had enough (pennlive). Jerry Sandusky is a sexual predator that used his influence in the community of State College to protect himself as he sexually assaulted ten boys over fifteen years(O'Neill, 2012). Most of the new information revealed is about the case as it went through the different stages of the criminal trial. The trial took place at the Centre County Courthouse and is seen as a necessary part of healing and moving forward for the victims of the sexual predator(O'Neill, 2012). Sandusky was successful at manipulating his victims, friends, and the circumstances which allowed him to take advantage of troubled youth that were partaking in programs offered by the The Second Mile(O'Neill, 2012). Sandusky met most of his victims through The Second Mile nonprofit organization and was able to manipulate time with his victims while appearing to be a father figure to disadvantaged children(Hobson & Boren, 2016).Throughout all of my research it amazes me how bold Jerry Sandusky became with his victims and coworkers while plotting his attack on his victims.
There are so many unanswered questions left-over from this scandal that it really makes it hard to say that it was resolved and even harder to decide whether or not it was resolved in a positive or negative manner. This is also not to say that there weren’t ways in which the crisis was resolved in positive ways. The more positive ways that this predicament was resolved in are still able to be seen today as after all of this happened Congress passed various laws in regards to government ethics, campaign financing, and freedom of information. There are many influential items that were brought up during the trial that the judge used to impose his sentence. After a jury found him guilty of over 45 separate charges the sentencing process began, the judge made a statement regarding Jerry Sandusky's status in the community and the fact that he was able to become a predator without anyone knowing and was able to keep it covered up for so long (Bohm & Haley, 2014). The judge continued by also making sure that Sandusky knew the sentencing was being based on the facts brought up in court and that they are true beyond a reasonable doubt (Daily News, 2012). He also must consider the fact the way Sandusky not only committed these crimes but the way it occurred, such as how he abused the trust of the victims who at first had trusted him. These crimes that were committed were not committed against strangers and the judge makes a comment that just that fact makes this a whole lot worse than if it were actually being committed against a stranger (Daily News, 2012).
The possible biases in jury decision-making will be discussed, including those related to having a celebrity on trial. In addition, this paper will examine the taboo nature of sexual assault cases, the problems that often arise in such cases, and the psychological toll on the victim. One issue with this case is the prosecution’s lack forensic evidence. In a “he said, she said” case that lacks the evidence that jurors expect in order to make their decision, it comes down to whether they believe the defendant or the prosecution. When DNA is not available, other types of physical evidence are examined (LaPorte, G., Nguyen, M., Schwarting, D., Scott, F., Waltke, H., Weiss, D., 2017).
It is hard to imagine that someone who had built a reputation for encouraging, assisting, and guiding juveniles could commit such heinous acts. The details of the case are horrific in nature, and worse is five men were made aware of the incidents and no action was taken to alert authorities. During the trial the victims were led through questions that all pointed toward the trust they had in Sandusky. The university is located in a small town setting where people work hard and have little; Sandusky reaching out to someone was considered a big deal.
In The Laramie Project, by Moises Kaufman and members of the Tectonic Theater Company, we read the story of a homosexual hate crime in Laramie, Wyoming told from many different perspectives. Though discriminatory crimes against homosexuals have largely decreased, discriminatory crimes in general do still exist. This includes crimes against certain races, genders, and religions. America has come a long way since the events in The Laramie Project but we still have a long way to go in terms of women’s health and discriminatory crimes. Religious voices play large roles in The Laramie Project.
