Difficult conversation is common in our society. Everyone should learn how to communicate effectively. Changing the delivery of a message to focus more on the positive attributes will help solve a dispute. Make sure you focus on the interest of the other party not your position. Framing effect in psychology will make people bias by reacting to a situation based on the idea of loss and gain. In 1981, Tversky & Kahneman experiment came up with a result that most people will focus on the positive side even when the result was completely the same. For example, from the data they found out that people are more likely to choice 200 save out of 600 people then 400 will die out of 600 people. Mediation is a good form of alternative dispute resolution because it low in cost. It will also help speed up the filing a law suit that can take months even years to resolve. Confidentiality and Low risk are also advantages of hiring a mediator. When you seek a mediator, you want to hire a person that is neutral and trustworthy. You also want a person that will hear and acknowledge your situation. That person has to be creative by giving advices about how to resolve your problem. A right based approach person focuses on the legal right of the parties. This person will attempt to achieve a resolution which meets the legal criteria of the dispute. An interest based approach person focuses on the needs or interests of the parties that are involved. This person will encourage wider range of resolutions to the dispute.
