Pluto Fainting Case

The case at hand is a very unfortunate circumstance because although Pluto did experience minor fainting spells in the past, I do not think that Pluto knew how serious the fainting spells were therefore I think that he should be charged with causing death and bodily harm, however, I do not think that Pluto should get the full sentences associated with the crime. Linden R., (2016) states that if a person knows they are liable to experience sudden fainting spells and continued to drive a motor vehicle without a medical clearance to do so then they are guilty of the crime that they cause. In this case, Pluto only experienced these fainting spells a few times and he did not ever experience it while driving, his intentions were not intentional in the sense that he genuinely tried to avoid the situation from occurring but the breaks in his car prevented him from controlling his car. Pluto could have possibly came to a complete stop before reaching the children and before his fainting spell occurred but his breaks were not working and he could not stop the car, instead he had to do something in order to avoid the children. …show more content…

He did not have much time to make the most rational decision, he had to immediately decide whether to potentially injure five people or just one person, although neither are a circumstance anyone would want to be a part of and even though Pluto did end up killing one person, the decision he made most likely saved the lives of the children because he possibly could have killed the children if his car had crashed head on with the them rather than returning onto the road and only causing
