Role of cases in shaping and improving services All of the following cases have made an impact on the establishment and delivery of special education services. Individuals with disabilities went through a period of being completely excluded from the education system to having laws and regulations mandating their education with adequate support and evidence-based practices. The following contributions have been made over the years. Supreme Court Decision Brown v. Board of Education of Topeka (May 17, 1954) Brown v. Board of Education prohibited segregation in schools on the basis of race and was a landmark decision that brought great awareness to the education of individuals with disabilities. As a part of the war on poverty, this act sought to create a standard of services by providing federal funding to improve educational opportunities. Pennsylvania Association of Retarded Children (PARC) v. Commonwealth of Pennsylvania (October 8, 1971) Discrimination against individuals with disabilities was declared unconstitutional and the PARC case declared that all children were capable of benefiting from education, education must consider societal skills and contributions and not just academics, the state cannot deny a child with disabilities access to free public education, and better learning outcomes occur with early educational opportunities. PARC set the precedent for service by establishing the right to free appropriate public education (FAPE). Mills v. Board of Education of the District of Columbia (December 17, 1971) In the case of Mills v. Board of Education, since segregation based on race was declared unconstitutional, discrimination depriving children with disabilities of an education was also declared unconstitutional.
