There are many mistakes made when it comes to the church and legal matters. The church communities have enviable rights under the First Amendment. Do the church communities understand the power of these rights? Maybe or maybe not, but under the First Amendment the government must adhere to the constitutional guidelines for the church. The government has a good working understanding of all guidelines concerning the church and legal matters. Therefore, it is the church and its administrative surroundings that needs to have a working understanding of their constitutional rights. The IRS definitions for a legal church are as follows: When establishing a church, they must have a place of worship, recognized creed and form of worship, definite and distinct ecclesiastical government, distinct religious history, literature of its own, ordained ministers selected after completing prescribed courses of study, ect. Under the First Amendment it guarantees your right to hear and speak the truth. Under the First Amendment churches can enjoy public funding and have access to public buildings. Under the First Amendment the government cannot tell the church how to teach, preach and pray in their place of worship. Pastors have the right to speak out without fear of government interference or attacks. The beauty of church vs government is the church is protected and the government cannot legally tell the church how to govern their church as long as all legal guidelines are met. The government cannot interfere with the preached message on Sundays. Nor, can they tell you how to share in public forums or drive the pastor and his member’s off public sidewalks, parks or any public building in which they are dutifully sharing their
