This remix also does not substitute for the original Disney Works in any conceivable market, which means it is not market harm as well. The supporting material found to show fair use in this because the Disney studios claim that they have more cups shown and that is copyrighted, but the copyrighted rules say that the
To address the audience portion of that I would like to point out that previous to this Remix we had done another project where we presented to the class so my group had a pretty good idea on how to reach our target audience. All we had to do is convert our pieces about ourselves into something that could reach a broader audience. We thought that the best way to do that is to embody more people's experiences and stories. To get this done we interviewed a couple of people we thought that would have backgrounds different than ourselves. We answered questions that pulled ideas from each piece of writing.
In this case, Kidd Wes sought damages for lost profits, royalties, and reputation, while Donald Glover and his team argued that they had not copied any protected elements
Even though Faden didn 't ask he still gave them credit at the end of the video and at the beginning because he put their intro that they use for movies. He should win because one he is still a school kid and he looked up disney’s rules about their movies. His work fell under fair use because his intent was not to make money but to educate. It wasn’t copyright because he was only using it for a class he wasn’t going out in public trying to sell a bunch of copies of the video. If he was doing that it would be copyright and disney would be able to sue him, but because he didn’t do that and it was only for education disney cannot sue Eric.
Walt Disney was one person who was greatly impacted by the free enterprise system, and who greatly impacted the buisness world. Ho was not only the pioneer of animation, but he has built two multi-million dollar theme parks, that many people today enjoy and come from all over the world to see. Most people think that you have to be rich and have lots of money to become an entrepenur, but many people start off with nothing at all, that was the case with Walt Disney. He started off with nothing, living out of his office and eating cold beans before he became the successful entrepeneur he is today. "if you can dream it, you can do it," was a quote Walter lived by an it must have been a big help in getting him where he needed to be, but he didn't
Approximately 5 to 10 percent of the videos were composed of copyrighted music and appearances of Presley on television and in movies owned by copyright holders other than Passport. Passport did not obtain permission to use those copyrighted works. Elvis Presley Enterprises, Inc., and other companies and individuals that owned copyrights to the Presley works used by Passport sued Passport for copyright infringement. Passport defended, arguing that its use of the copyrighted materials was fair use.
So to recap what was said in the other paragraphs Professor Faden did not copyright anything because he stayed with the fair use policy by using small samples of recorded audio, not making a profit off of it, and most importantly mashed it up and remixed it with other pieces of movies to create something new and original. By not making any money off of it he stayed within guidelines, and since he took only small pieces of the original work and made something new he again stayed within copyright laws. The video Professor Faden made was also made for comedy reasons another way you can stay in fair use. Now should 've Professor Faden asked disney if he could use their work, most likely but that doesn 't make it automatically illegal and sued for copyright. Instead disney and Professor Faden should have a compromise about this dispute by making Professor Faden agree to not doing anything like this again unless he has gotten permission from one of the head authorities and should also be given the opportunity to keep his work on the internet for people to use since after all it wasnt copyright to begin
