Jessica Fiyero is a 19 year old who has come to see Jessica for counseling. Fiyero is in a long term relationship with his boyfriend of 3 years. His boyfriend is 16. The state they are in requires the age of consent to be 18. Fiyero is also Deaf. Jessica doesn’t know ASL (American Sign Language) so Fiyero needs an interpreter. Throughout a few sessions Jessica learns that Fiyero is sexually active with his boyfriend. She also learns that his boyfriend’s parents know about it and understand. In this scenario there is an issue of confidentiality with Fiyero, since he requires an interpreter. How do you deal with the third party in the room and making sure that Fiyero still has his confidentiality? Without his interpreter Fiyero would only be able to read lips and wouldn’t be able to effectively communicate with Jessica. Fiyero also can’t find any therapist that know ASL, and since Jessica specializes in queer youth she is Fiyero’s best option. The ACA code of ethics 2014 list the codes for referral. A.4.a. is Avoid harm, by reporting the rape you would be harming your client and by refusing to counsel him you would be harming him. B.1.a. Multicultural/Diversity considerations and B.1.c., taking awareness of the confidentiality needed with a Deaf client and their interpreter. B.1.d. Explanations of limitations, explaining that I have times in which I may have to breach confidentiality, such as harm to a minor. B.2.a. Serious and Foreseeable Harm and Legal Requirements, if Fiyero’s boyfriend’s parents were to change their mind about the sexual activity there could be major legal issues if I don’t report. C.5. Nondiscrimination, if Jessica were to refuse to keep seeing Fiyero she could be discriminating against him. Also referring to the laws around statutory rape in the state would help, if we knew what
