The delegates of the Constitutional Convention wanted to divide power in the Federal Government. They believed that if a small group received too much power, then this country would lead into a dictatorship. The reason we have a three branches government is to avoid this issue. There are three branches of government. There is the Executive branch, Legislative branch, and Judicial branch. The Executive branch executes or enforces the law. The judicial branch oversees the court system of the U.S. Through court cases, the judicial branch explains the meaning of the Constitution and laws passed by Congress The Judicial branch is basically the referee. It is there to clarify the rules and to be sure that both sides are acting fair. The main body of the Judicial branch is the supreme court. There are nine justices who sit on the Supreme Court. There are 8 associate judges and one Chief of Justice. The reason it isn’t an even number is to reduce the chances of tying in a case. They simply need a majority of justices to agree. Being justice on the Supreme Court is a very prestigious position. It is the highest Court in the United States. Decisions made in the Supreme Court are final. There is no other Court that can overrule those decisions. Once you are approved and confirmed, you serve for life. The Judicial process guarantees that every person accused of a crime or wrongdoing has the right to a fair trial. You have the right to a legal representation, right to a speedy trial, guaranteed that no person is deprived of land, liberty, and life without the due process of law, protection against being tried twice for the same
