Utilitarianism states that, actions are right if they tend to promote happiness to the majority and wrong if their consequences don't bring forth happiness. it stipulates that actions should be classified either morally right or wrong if their results are of such significance that a person would wish to see the other person suffer. As outlined in the utilitarianism ethical theory, it is totally justified that companies should not use online check as the only basis for not hiring applicants. Online communities are developed for people to interact with each other, and this should be protected. Moreover, employees should have privacy about their lives, and there should be a boundary between one's work and personal life. Utilitarian have supported democracy; they believe that every individual is the best judge of his/her welfare, and they believe that every act should bring happiness to the majority. They believe that a morally right action is one that brings the best. The action of employers using social networking sites to select their candidates is not a moral right approach and should be avoided. If this process is continued it will results to many human resource functions being affected such as recruitment, hiring, promotion and termination of the contract. Recently a female server in a restaurant in California was fired due to her Facebook post where she had threatened a customer after leaving a poor tip. Another case evidenced was the American law student who was fired after the firm found that the student was affiliated with a website that spoke negative about his colleague even though the student had not posted any offensive remarks. Recently a CNN producer was fired for blogging off
