As shown in this article sport betting and fantasy sports sites are not legal distinguishable from Horse Racing and the lottery. Betting on fantasy sports is considered a skill and it is not just picking who has the best odds of winning or just having a person with inside information knowing that something illegal is going to happen betting on a team that they think is for sure. This is proving that they are not legally distinguishable from each other in any way. The only way they differ is that one is placing bets on humans and the other is placing bets on horses. They are also the same in that both are considered a sport and betting on a sport is legal while betting on a poker game or other card games is not legal in New York except on Indian reservations. Next is that with no real cases involving horse betting being illegal on reservations it is hard to tell what is making New York decides on what kind of gambling is legal and can be changed by them and what would cause them to legalize all gambling. New York is debating on adding sport betting on from their new stare casinos that have been added in 2017 including Rivers Casino in Schenectady, NY because they are making 15% of profits from all DFS operators which totaled almost $3 million during the first period of allowing fantasy sport betting.
