Michigan vs. Bay Mills is a recent case that was decided by the Supreme Court in 2013. I chose to research this case for my judicial process class because I found it interesting. It is interesting because I do not know much about the United States federal government, states and Native American tribe’s current relationship. I have always thought that Native Americans act on their own government system with no interference from the United States almost like they are a separate country/ nation just residing within the United States. However, after researching the Michigan vs. Bay Mills court case I now understand that its relationship is more complex.
The main reason why the Framers didn’t succeed in their final compromise is because it was too difficult to make all the delegates (who were basically competing) agree with each other, so numerous issues were ignored and most plans were severely compromised. An example of this is the debate between larger and smaller states over their representation in the newly proposed Senate. Two solutions were significantly favored: the New Jersey Plan and the Virginia Plan. The smaller states were in favor of the New Jersey Plan, which would enforce each state to send the same number of representatives to Congress. The larger states supported the Virginia Plan, which called for each state to have a different number of representatives based on the state’s population.
While some Native American leaders and organizations have criticized Collier's policies as paternalistic and not fully effective, others recognize the importance of his efforts to promote self-governance and cultural preservation. One of the main ways in which the US Government obtained Native American lands was to offer them terms within treaties. Congress declared that the only treaties ratified by them would result in the legal seizure of native land. These treaties frequently offered some sort of payment or guarantee to “compensate” the native for land forfeitures. Federal regulation of the fur trade was an attempt at obtaining control of the Native Americans. The Fur Trade was prevalent for both settlers and the natives.

The Dakota were being squeezed into smaller areas. Moving from previously prime hunting and fishing grounds to increasing smaller non-productive reservations, harsh winters and low supplies created times that that left many native families hungry and frustrated. Throughout the 1800’s, treaties were negotiated with the Dakota and the U. S. Government and native lands were exchanged for money, farming supplies and debt payments. These treaties were not in favor of the native population. By the late 1850’s, treaty violations by the United States and late or unfair annuity payments by Indian Agents, those authorized to interact with natives on behalf of the U.S. Government, caused increasing hunger and hardship among the Dakota.

Though the legislature was goal was to drive tribes onto reservations and let them make sense of another lifestyle all alone, numerous Native Americans were not in agreeance. They organized into associations and rights groups and worked together toward one main goals, which was to convince the government to pass enactment that would ensure and help Native Americans Assimilate. By the year 1871, through many efforts on boths side it was clear that sending tribes to live on reservations was not a successful solution to the government 's dilemma.
The United States federal government tried to resolve its bond with many different Native tribes by treaties. The treaties were formal agreements between the United States government and the Native Americans. Treaties were made by the executive branch on behalf of the president and then ratified by the United States Senate. The treaties made it where Native American Indians would give up their rights to hunt and live on huge sections of land that they had inhabited in exchange for trade goods, houses, and assurances that no further demands would be made in the said treaties (NebraskaStudies. Org).
First of all, Native Americans were settled on a hotbed of natural resources which included oil and precious metals such as silver and gold. There was also much fertile land that would entice farmers and frontiersmen to move out west. On this land there was so much potential economic opportunity for farmers, cattle drivers, miners and many other occupations. The government developed the popular public misconception that the indians were misusing the land and that Americans had the right to take advantage of the opportunities that lie in the west. These ideas led to the Dawes Severalty Act of 1887 which authorized encroachment of Indian lands by the US government in order to divide up reservations and control Indian activity.
These issues can still improve through cooperation and understanding, however, and reaching a satisfactory decision about the Dakota Access Pipeline provides a perfect gateway to uplifting improvement of the reservations’ lifestyle. If the government agrees to give a little, a great opportunity arises for them to get a little as well. In the last decades, lack of funding has led to blatantly subpar education for the majority of Native American students, even when the government made an attempt to intervene due to an understandable inherent distrust of Government interference. Through a monumental compromise via the Dakota Access Pipeline, the government could prove its decency, transparency, and trustworthiness, which would advance the relationship of Native Americans and the United States Government brilliantly. The newfound trust could easily apply to areas such as financial welfare, educational support, and government-run health clinics.
Throughout the 19th century Native Americans were treated far less than respectful by the United States’ government. This was the time when the United States wanted to expand and grow rapidly as a land, and to achieve this goal, the Native Americans were “pushed” westward. It was a memorable and tricky time in the Natives’ history, and the US government made many treatments with the Native Americans, making big changes on the Indian nation. Native Americans wanted to live peacefully with the white men, but the result of treatments and agreements was not quite peaceful. This precedent of mistreatment of minorities began with Andrew Jackson’s indian removal policies to the tribes of Oklahoma (specifically the Cherokee indians) in 1829 because of the lack of respect given to the indians during the removal laws.
The treaty stated that the indians had to allow travelers into the lands, allow government to establish roads, pay for wrongdoings of their people, and avoid conflict with other tribes, while the US government offered protection from US citizens and annuities if treaty of followed. However, issues with the treaty arose as Indians didn’t have full translation of the terms, an example of the government’s sovereignty ruling over ethics. In 1868, the treaty commision met again to improve the terms of the treaty. The US government established the Great Sioux Reservation where the indians could preside.
Many people wonder what the New Deal really did for the American people. The New Deal was a series of national programs proposed by President Franklin D. Roosevelt. The New Deal programs happened during 1933-1938, right after the Great Depression. The New Deal had a very positive effect on the people of America by creating new jobs, gaining trust in banking systems, and getting freedom from the effects of the Great Depression.
