According to “Kids in Prison” by Brian Hansen, juveniles are being tried as adults for violent and non-violent crimes. Kids being tried as adult is the most controversial topic the world cannot agree on today. It is hard to pick one side due to every case being a different situation, but I think I have established a well-thought opinion. Children should not be tried as adults due to their level of cognitive capability, proneness to harm in adult prisons, and their inability to be rehabilitated in a harmful environment. First, a child’s cognitive thinking is at a different level than an adult’s, so a child does not have the means to survive in an adult prison.
1. Do children/juvenile have the capacity to understand the consequences of their crimes? Are the children/ juveniles able to be rehabilitated? Answer: Juveniles are between the ages of fifteen years and seventeen years of age. So, no they should not be tried as an adult because they are not eighteen years of age.
Juveniles shouldn’t be tried as adults. First, they are too young to understand and to perceive the problem. Second, the punishment is too harsh for juveniles to handle. Lastly, we should give them a chance to change as they still are young and be able to change. Would you put your kids in jail for the crime that they cause at the age of developing, the age of teenagers?
The juvenile must be charged with a serious offense, has a lengthy juvenile record, past rehabilitation efforts have been unsuccessful, and youth services would have to work with the juvenile for a long time. Being tried as an adult has its advantages and disadvantages. The advantages being an adult jury may feel sorry for the juvenile and if the court has a lot of cases the juvenile case is more likely to get disposed and receive a lesser sentence. The disadvantages would be higher possibility of facing a more severe sentence, may have to serve in an adult prison, and adult criminal records are harder to seal than juvenile
Juveniles should be trialed as adults because they cannot commit more crime when they are in jail, hey cannot commit worse crimes, and itm is safer for the community. I think that juveniles who are under 18 should get trialed as adults. In 2012 the supreme court ruled that Juveniles under the age of 18 can not receive a life sentence or be put to death without parole (lauck). But what if some one under 18 committed a crime that a 23 year old committed why should one get life or be put to death while the other one gets a smack on the wrist and gets away scot free, the under aged person can be just as bad as someone who is over 18.
There are many teens doing time for as an adult for minor crimes. Many people may argue that it's unfair due to the fact that teens aren't mentally grown. While, on the other hand, some may say that it's fair that teens get tired as an adult because they know what's right from wrong. Teens should be tried as an adult because the crimes they commit are not by accident, teens causing a crime just shows that teens are capable of doing anything, such as robbing a store or murdering someone. The juvenile courts do not have a jury, and offenders are not given a proper trial.
There are certain crimes, no matter the age of the perpetrator and should be punished by receiving the most serious and lasting sentence. Being tried as adults exposes the juveniles to state penitentiaries and
There is an estimate of about at least 7,100 juvenile defendants who were charged with felonies in adult criminal. In the articles we have read there are two sides to each story. In these stories we hear why the should be tried as adults and why they shouldn’t. Should juveniles be tried as adults? From what i have been learning and listening to both sides of a story.
Juveniles should be treated as adults for serious crimes because of punishment. Children should be tried as adults because they could be surrounded by dangerous criminals and look up to them as if they’re making the right decisions. They could not know better if someone told them, ‘We want you to go out and do your first killing, and don’t worry
Alex King killed his father at the age of 13, he got only 7 years in prison. Once he was out, he got into a car accident and ran from authority going back into the system. This is just one incident, now moving onto Nathaniel Abraham, who killed a 17 year old when he was just 11 years old got only 10 years in a juvenile facility. Abraham was not tried as an adult, got out was charged with not only drug possession, but also charged for assaulting 2 guards facing more time in prison. Therefore, not trying juveniles as adults will or possibly can lead them to committing other minor or major crimes.
Juveniles who commit felonies should not be convicted as adults because of the lack of mental maturity and differences the two have. “Adolescent brains are not fully developed until eighteen to twenty-two years of age” (“Juveniles and the Death Penalty”). Furthermore, juveniles committing crimes do not have the life experience to make better choices. As a result of not having a large mental capacity, teens convicted as adults will be sent to adult prison. According to Huffington Post, “Adult prisons are not designed with minors in mind” (Mortales Gomez).
Juveniles should be tried as adult because they should be responsible enough for what they do. Committing a crime doesn’t have age requirements, but why does juveniles have the same consequences as
Juveniles should be convicted as adults for violent crimes because it is not fair for juveniles to commit big crimes and get away with it so easily. If they want to act like adults, they should be treated. Some teens commit crimes and don't have a really good excuse on why they do it. In the article “On Punishment and Teen Killers” by Jennifer Jenkins she explains how the teenager that killed her sister, husband and her unborn child excuse of killing them was that he just wanted to “see what it would feel like to shoot someone”, which is no good excuse for what he did to this family. Another example from Jennifer's Jenkins article she states how “undeveloped brain” has nothing to do with teens committing these crimes.
In my opinion, I think that juveniles should be prosecuted as adults depending on the type of criminal offense that he or she commits. If a juvenile commit petty crimes such as petty theft, disorderly conduct, vandalism, etc. then I think that they should be tried in juvenile court. However, if a juvenile commit any of the seven deadly sin in criminal justice then they should be prosecuted as an adult. The seven deadly sin include: Murder, rape, armed robbery, kidnapping, aggravated battery, aggravated sodomy, and aggravated child molestation.
The consequences may affect the minors negatively. Minors have a higher chance of rehabilitation if they are tried through juvenile court so that they can become better members of civilization. Despite that, some people think that minors may not learn their lesson if they are put through juvenile court, but minors should not be treated the same as adults. Minors should be treated for their age, not their crime so that they have the opportunity to change and become a better member of
