Special Education Court Case Summary

There are many court cases that have had a contribution to the special education history. For my timeline, I started with Brown V. Board of Education. This court case started in 1954, and it took place in Topeka, Kansas. It is known as one of the biggest Supreme Court cases in education in the 20th century. The ruling on this case was, “Separate cannot be equal.” This led to racial desegregation of public schools. This case had a major effect on special education, and it led to parents with children with disabilities beginning lawsuits against their school districts for segregating children with disabilities. The next court case listed on the timeline was the Elementary and Secondary Education Act of 1965. This case addressed the issues of inequality of educational opportunities for underprivileged children. “This law mandated free public education for all children with disabilities ages 6 to 21 and provided with financial assistance. “ The law was one of the biggest special education laws helping out the financial cost of families of children with disabilities. In 1990, the Individuals with Disabilities Education Act was enacted. This act required that all of the students’ evaluations for special education must be given in the child’s native language. It also states the parents must be informed of the evaluations their child is going to undergo for special education. IEP’s were also introduced during this time, and an IEP is an Individual Educational Plan. The plans must state modifications for instruction and materials needed for both native language and English as a second language
