Why was education unequal in the United States until the middle of the 20th century? Before the 1950s, schools discriminated and segregated students because of race and culture. This sparked Americans to fight for student rights in public schools. The first important case related to special education was Brown v. the Board of Education (1954.) The lawsuit argued African American students should integrate with Caucasian students, and isolating students by race was an abuse of the Fourteenth Amendment equal rights to all citizens. The federal court district rejected Brown’s claim referring to Plessey v. Ferguson (1896) in which separation by ethnic group was permitted if the locations are considered equivalent. The lawsuit progressed to the supreme court for appeal and the judgment on May,17 1954 created integration of African American and white students in public schools. Board of Education (1954.) Supporters of special education students started to rally and file complaints against school districts. Pennsylvania Association for Retarded Children (PARC) v. Common Wealth of Pennsylvania (1972) developed from complaints of students with low cognitive abilities exclusion or segregation. The plaintiff used Brown v. Board of Education (1954) decision declaring students with disabilities were often excluded from public schools in Pennsylvania because of low mental and physical abilities. The case did not progress to the supreme court and was settled in the District Court of Eastern District of Pennsylvania, the former Pennyslvania state laws were considered unlawful and the state must provide education to all children six to twenty-one years old including students with disabilities.
