On July 28, 1955, plantiff ,William A. Drennan, a licensed general contractor. Drennan, was preparing a bid for the local Lancaster school district. Drennan received over 74 bids from various sub-contractors, some by phone. Drennan submitted his bid with Star Paving as his sub-contractor for the paving portion of bid. Drennan was subsequently the lowest bid and was awarded the Lancaster school district project. Drennan stopped by Star Paving offices on his was to Los Angeles, the morning he won the bid. Drennan was informed that the bid he had received was a mistake. Star paving informed Drennan that he job could not be done for less than 15,000$ and not the original price of 7,131.60$.
