Addressing the secession of many southern states, Lincoln said “It is safe to assert that no government proper ever had a provision in its organic law for its own termination.” The U.S. could not be legally broken up. The Constitution does not allow for such a form of divide. The U.S. already tried operating as separate states in the form of the Articles of Confederation. An attempt like that has already been made, with little success.
I don't necessarily agree nor disagree with the author. America has basically been doomed from the start. When the 2nd amendment was created James Madison probably didn't think that 100s of year later citizens would use it for as an excuse for mass murders across the country. The amendment will not be nullified anytime in the near future because most states wouldn't support this decision. Most citizens own a gun either legally or illegally for protection.
Today, it’s hard to imagine the U.S. Constitution without the Bill of Rights. However, when the founding fathers we’re drafting the Constitution they didn’t feel the first ten amendments were necessary. The three men that believed these amendments should be included were, George Mason, Elbridge Gerry, and Edmund Randolph (4). James Madison was responsible for drafting the document and came up with seventeen sections (4). This number then got reduced to twelve, but only ten of those twelve were ratified.
Ever since the Constitution was written, chaos has ensued. The states have split into two sides: the Anti-federalists, who oppose the Constitution, and the Federalists, who support the Constitution—both of whom have argued in writings, such as the Federalist Papers. Anti-federalists rightfully believe that a president has enough power to become a tyrant, similar to British kings in the past. Therefore, they request for a Bill of Rights to be added, ensuring that the citizens have power in government as well, in order for them to ratify the Constitution. However, the creators of the Constitution also left somethings out so that future leaders could determine and interpret laws in a way where they were not really restricted to doing something one specific way. This helps a lot when it comes to the changing of times because the time during in which the Constitution was drafted and ratified, the environment of the nation was much different from what it currently is today. On the contrary, although the defendant didn’t violate those the limitations stated by the First Amendment, the First Amendment does have other limitations such as the First Amendment applies differently to students in school. As the Supreme Court ruled in the Tinker case, it states that “students are not granted an unlimited right to freedom of speech or self-expression by the First Amendment, because First Amendment guarantees must be balanced against a school’s need to keep order and their school policies. Another example is the case Bethel School District v. The second amendment states that well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed. This amendment has brought upon debates for control. For many the gun symbolizes crimes, sexual frustration, aggression, violence, and all that is wrong in American culture. For others it symbolizes, manliness, independence, outdoorsmanship, and willingness to die for one's believe (La valle). The debate over Gun Control has peaked in recent years due to societies opposing conflict and a lack of compromise.
The Second Amendment (in the constitution) is one that can bring up hours and hours of debate, maybe the most of them all. These debates, unfortunately, will never come to an end because there will be know agreeance in what would be done. In my opinion, what is trying to be done right now is not going to work, the politicians in office right now want to stop the weapons and not the perpetrators. Every time there is a mass shooting/bombing the idea of gun control comes up and it is not going to get us as a nation anywhere because that is not the issue. We know who is doing these mass murders such as the Boston bombings, Paris attacks, San Bernadino shooting, and Brussels attack that happen just this morning, stricter gun laws would not have
The First amendment also protects speech (Hall,2016.) The plain language of the clause, several words mean something different than what is plain (Hall, 2016.) First, the clause limits the authority of Congress, but in reality it limits all three branches of the federal government (Hall, 2016.) Second, the term speech is used (Hall, 2016.) The Supreme Court has held that more than the spoken word is protected (Hall, 2016.)
The First Amendment states that there shall be no law respecting an established religion, preventing the freedom of speech, or preventing the right for people to hold peaceful assemblies. I personally believe that the freedom of speech is the most critical out of the three freedoms. The freedom of speech encompasses all the freedoms in the First Amendment. Without the freedom of speech, there can not be peaceful assemblies or the freedom of religion. All of the freedoms requires the right to freely express opinions.
While having free speech can be a problem and anger many, it IS one of our basic freedoms. The Bill of Rights was added to the Constitution as the first ten amendments on December 15, 1791 and the fact that American’s rights were not protected and added to the Constitution any earlier heated up numerous debates! The First Amendment protects freedom of speech, press, religion, and petition. It is very well one of America’s special aspects and for some American’s, it is their most cherished personal freedoms. With that being said, I do not see a problem with one having the ability to speak their own opinion, I just think their should be a few limitations.
The first amendment gives us our freedom of religion, freedom to peaceably assemble, freedom of the press, and freedom of speech (Obscenity and Pornography. Cencage). The first amendment counteracts the government from restricting the amount of details and information that is allowed to be shared. With that being said, that does not necessarily mean that there are no limitations. If the outcome is a crime then it is not protected.
Legislatures in the United States continuously attempt to restrict the flow of new forms of entertainment that their constituents believe to be harmful to society. Yet, from the lower courts to supreme courts, contested legislation is overturned. The First Amendment’s assertion of the freedom of speech is afforded the highest standard of judicial review and very few exceptions are allowed. These exceptions to free speech are obscenity, incitement, fighting words, slander and libel. However, while adults enjoy the full extent of the priviledges in the Bill of Rights, minors are viewed as needing special consideration in certain situations.
The First Amendment guarantees freedoms concerning religion, expression, assembly, and the right to petition. There are many ideas expressed in times where it would be inappropriate or unnecessary to use one’s freedom of speech. These circumstances would be where something is inappropriate or misidentified as hate speech. There are many situations where someone may want to say something, yet there are times where some things should not be said.
