In summary, on 08/07/15 at 2333 hours Ofc. Drakulich #255 and I were dispatched to 5100 W. Cermak Rd. (Burger King) in regards to a fight. Upon arrival, I made contact with a Burger King employee (Mejia Jr, Mejia DOB 11/04/93), who related he was walking toward the front entrance after taking out the garbage, at which time he was approached by an unknown male black subject. Mejia further related he attempted to open the entrance door, but it was locked. The male black subject was frustrated because he was refused service through the drive up window, due to not being inside a vehicle. Mejia further related the male subject took a boxer fighting stance (approximately 3-4 feet away) and attempted to provoke him into a fight by verbally stating "let 's go". Mejia related the male subject was wearing a backpack and he was unsure if the male subject was armed with a weapon. Mejia further related the male subject closed the distance between them and he was afraid of being struck with a closed fist. Ramirez related a male black subject on foot attempted to place an order at the drive-up window. Ramirez further related it is against Burger King policy to serve customers, if they are not in a vehicle. Ramirez related she recognizes the male subject because he has attempted to do the same thing in the past. Ramirez related she observed the male subject attempt to fight her employee (Mejia) in front of the the main entrance, at which she open the front door to let Mejia inside.
