1. Identify areas of law addressed in the media report, and explain how they are relevant to the matters outlined in the media report. This article reports on the misuse of funds by the senior staff and board members of Healthway. Administrative Law Administrative law is a body of the law that has control over the administrative organisations of the government. Healthway, Corruption and Crime Commission (CCC) and Public Sector Commision mentioned in the media report are clearly examples under administrative law. According to the government of Western Australia, Healthway functions under the Tobacco Product Controls Act 2006. Embezzlement, which is a white-collar crime, is a form of criminal offence that can lead to serious punishment by the court. Under the Criminal Code Act Compilation Act 1913, Part III, Chapter XIII, it is stated that anyone who is involved in any form of corruption is liable to imprisonment for 7 years. Even though the senior staff and board members of Healthway involved in the criminal offence were not punished but it is shown that those involved had left the organisation. Law plays a vital role here as people who are afraid of imprisonment because of the lack of freedom may avoid such offences. It protects the community and gives punishment to those who does not abide it. For instance, corporations law allow the senior staff and board members of Healthway to understand their duties better. If they had a better understanding of the law and were responsible for their actions, Healthway’s reputation would have remained good as always. Moreover, the board members could have stayed in Healthway, not needing to resign. Besides that, having the knowledge of law when entering into a contract is also important. With the comprehension of the law, one is able to fully understand the terms and conditions of a contract and can protect themselves from being deceived. In the media report, Mr Malone have succeeded in applying the law to his advantage. He was given a $226000 payout when he left Healthway, along with a good reference from Dr Capolingua. At the same time, Healthway also applied the law to its advantage. The contract between Healthway and Mr Malone bound them against making unfavourable comments about each other.
