Introduction For my paper, I chose case study number one that follows Mr. John Burke who committed the crime of first-degree murder. I will explain the process John Burke’s crime and what process he will be going through while in the American criminal justice system. This process includes a number of steps starting with Mr. Burke’s initial arrest and later ending with Mr. Burke’s subsequent release from prison and entry back into society on his own unsupervised. I will also touch on what I feel are the strongest and weakest parts of our criminal justice system, and I will give supporting evidence to my claims. Brief Description of the Crime John Burke
The chief of Metro Nashville Police Department is Steve Anderson. Anderson has been the chief of the department since 2010 and a member of the department for since 2010 and a member of the department for 39 years having worked his way up the ranks (Metropolitan Nashville Police Department, 2015). The criminal justice system may be more corrupt than the people who fill our prisons. It is amazing to see the many ways that certain parts of society actually benefit from the current system we support. This book,The Rich Get Richer and The Poor Get Prison, by authors Jeffrey Reiman and Paul Leighton, has open my eyes to a very corrupt idealism. They are very precise in their supporting examples as well by walking the reader through each step and analogy.
In chapter one, Joel Samaha discusses the road map of criminal procedure. Throughout the roadmap, the author demonstrates the overall guidelines as to how one is eventually institutionalized. The author claims the vast majority of law abiding citizens seize to surpass the first part of his ideal journey. Thus, Samaha begins with the idea of in public; ultimately, explaining the general supervision of police officers in society. Police officers are responsible in investigating suspicious behavior in public places varying from public streets, roads, highways, public parks and restaurants.
How would the criminal justice be different today if the founding fathers had decided not to create a separate system of federal courts and instead allowed federal laws to be enforced? Students in the criminal justice department are taught that our main objective in the justice system and our careers is to serve and also protect those involved in our community. For as long as I can remember, my goal in life has been to provide service by protecting and serving those who are close to me. My penchant for service is what eventually led me to the Criminal Justice program at Valdosta State University. This passion for service began at a very young age when my life was turned upside down when I relocated from Puerto Rico to the state of Georgia due to a tragic car accident that led to the end of my father’s life. The court system is made up of different types of practitioners. Each criminal justice practitioner plays their own role in the system and each practitioner depends on what the other does. The hierarchy can impact a criminal justice practitioner by ensuring that each practitioner has a set goal. The hierarchy ensures that all practitioners are carefully planning, organizing and managing their cases. If a practitioner were to make a change or not interact with the other, the system would not function properly.
In 2008, continually elevating degrees of criminal activity prompted considerable public concern and ultimately the demand for the reform of Mexico 's judicial system. With the approval of President Felipe Calderón, the Mexican Congress introduced a sequence of significant changes to Mexico 's flawed and antiquated legal system. The reforms consist of four fundamental elements; substantial alterations to criminal procedure, improved attention to the due process rights of both parties involved, redefining the role of law enforcement within the judicial system, particularly concerning criminal investigations, and a more resolute agenda for resisting organized crime activity. Criminal Justice today is extremely important from how someone is prosecuted to how someone is helped in a situation. If there was not a Criminal Justice system, people would not know right from wrong. If they did it wouldn’t matter as much, they would still do as they pleased. Criminal justice isn’t just to correct people for doing wrong, it is also to protect people at the time and in the future. In order to do the above, there have to be different levels of authority.
For centuries, the criminal justice system has continually evolved and adapted to society where its sole purpose has been to punish those that break the laws deemed to be uncivilized. By punishing criminals, it attempts to maintain peace and order in society so that chaos and anarchy does not run amok. The criminal justice system we have today is divided into three sections, each with different responsibilities to uphold. The police are in charge of investigating and capturing criminals, the courts are in charge with the decision of whether or not a crime has been committed and if the person should be charged, and the corrections system is responsible for making sure the punishment given by the court is carried out (Mallicoat 2017:4). By examining the two contrasting ideologies of the criminal justice system, crime control and due process, we can see that our criminal justice system is flawed in maintaining public order and protecting our rights.
In the criminal justice system, the corrections component is also responsible for the rehabilitation of the convicted individual. It is their duty to attempt to make the defendant a productive member of society once again. Based on the individual’s behavior while incarcerated, the court and corrections officials may decide to place them on parole, which ensures that the individual will comply with the rules of society once they are fully released from the system. The criminal justice system is an essential role in the organizational structure of not only the United States but also in countries around the world. If there were no criminal justice system to administer punishment, the world would be unstructured, disorganized, unjustified, cruel, and not to mention a chaotic place for it citizens.
Define Organizational Effectiveness According to (Mihalicz, 2012) “Defining organizational effectiveness can help in the supervision of criminal justice personnel”. By using methods prioritizing sustaining and feedback it can help and assist with the tasks that are needed and it can help the organization with important with an implementation plan in the organizational setting. Apply Theories of Organizational Effectiveness to the Management of Criminal Justice Personnel
