The Second Amendment of the United States Constitution reads: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. "(www.law.cornell.edu). This document was written in 1775 and ratified in 1787, and from that day the amendment still stands. So, in a constructivist point of view is there still a need for a well regulated militia in the United States or is the second amendment outdated and should be trimmed with the new fabric of America? My personal opinion on the matter is with the new age of America becoming more hostile every day, there will be always a need for a milita.
Alters, Sandra M. Gun Control: restricting rights or protecting people. Detroit: Gale Cengage Learning, 2011. Alters, Sandra book was extremely useful in writing my paper. She identifies what the right to bear arms actually means and provides clarity on laws, regulations and ordinances for firearms.
There has been much debate in our society concerning the proposed laws of gun control violating the second Amendment, which states, “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed”. Per the Heritage Guide to The Constitution, “Modern debates about the meaning of the Second Amendment have focused on whether it protects a right of individuals to keep and bear arms or, instead a right of the states to maintain militia organizations like the National Guard. This question, however, was apparently never even discussed for a long time after the Bill of Rights was framed. When it was enacted, the Second Amendment applied only to the federal government,
“On March 10, 2009, Michael Kenneth McClendon, 28, shot and killed ten people in a shooting spree in three communities in two southern Alabama counties: Kinston in Coffee County, and Samson and Geneva in Geneva County. Five of the victims were family members and two were children. After engaging in an exchange of fire with police, he committed suicide, bringing the total of dead to eleven. Officials at the time said this was the worst shooting event in Alabama history” ((2009, March 10), Geneva County massacre. Retrieved from Wikipedia.
One of the most common arguments made while debating gun control is if the government places stricter restrictions on purchasing and using firearms, then civilians will eventually have the right to own guns taken away from them altogether. This is an example of the logical fallacy of slippery slope because it states that one first step (stricter regulations when buying firearms) will eventually lead to larger implications such as the government taking away the right for civilians to own guns completely. This is an argument that has been made by many groups advocating for looser gun control, such as the National Rifle Association, a massive organization with much political influence. The NRA’s website reads “In the face of gun-hating political
Do citizens have a “serious right to bear arms”? This is a normal question, not a Constitutional one. For the Supreme Court ruled that the Constitution does in fact grant this right, but it should be determine if there are sufficiently compelling arguments against private gun ownership to warrant changing the Constitution. On the other hand, if this were not a constitutional right, we should determine if there are strong reasons why the state should not ban or control guns, and if these reasons are sufficiently compelling to make this a constitutional right. Most protectors of private gun ownership claim we do have a moral right as well as a constitutional one and that this right is not an ordinary right, but a fundamental one.
According to the website “shooting tracker” it tracks the mass shootings in America, and in the past year there has been an overall of 355 mass shootings. In a year there are 365 days and the last mass shooting was on December 2nd in San Bernardino. To put in perspective, there has been 355 shootings in one year which means there has been a shooting almost once a day the past year. Gun Control debates cannot come to a conclusion on whether to tighten the use of firearms or leave it to the Second Amendment of our constitution. Almost all of the violent crimes that have appeared this year included the use of a firearm.
Background checks are not mandatory in the United States to purchase a lethal weapon, which is something that needs to change. According to Elisha Fieldstadt in the article, "Buying a Gun is So Easy 'It Doesn't Make Sense,'" "Only 13 states require a background check to be performed no matter how a gun is sold or what kind of gun it is according to the Law Center to Prevent Gun Violence" (Fieldstadt). The amount of blindly sold unlicensed guns is mind-blowing considering the number of mass shootings committed by people with mental illnesses, the most recent being the Parkland High shooter in Florida. Guns have become such an ordinary thing to own, that it is somehow overlooked how deadly these weapons can be in the wrong hands. `Fieldstadt
A stronger focus on gun control in the United States involving restriction or even an outright ban of guns could serve to help the problem greatly. In 2015, 13,286 people were killed by firearms in the United States, with 26,819 suffering from non-lethal injuries (qtd. in “Guns in the US”). Taking away guns, the means that many urban criminals have to commit their crimes, would be very beneficial to cities. Recent studies found that the most effective way of reducing gun crime is to lower the amount of guns available in circulation.
Have you ever thought of what would happen if there comes a time when you need to defend yourself with a concealed weapon? There has been some good debates on whether or not we should be able to carry concealed weapons. Gun rights is a very controversial topic that is a wide debate today, however, I don't think we need restrictions. Because some people think that guns raise crime it actualy lowers it and it makes the Americans feel safer, the 2nd amendment allows it, and it keeps the power with the people. We shouldn't have gun control because the reason that most americans carry concealed weapons is that it makes them feel safe.
Gun representation is a good idea Paragraphy 1: will this keep us more safe or less? Hook: Gun ownership is both a basic American right and one of the most contentious social and political issues of the day. Background: There are about 300 million privately-owned firearms in the US‐which works out to roughly one gun for every man, woman and child in America‐with nearly a third of the population owning at least one gun. Gun ownership is both a basic American right and one of the most contentious social and political issues of the day.
The issue of gun rights is an everyday issue that can be argued with support either way. one of the main problems is that we as Americans have been given certain rights through the first ten amendments that are interpreted different on a daily basis. However, the Supreme Court has a history of making rulings after what the Constitution says word for word. And even though they are shadowed out by the popularized shootings and other such events there are actually news articles that aid in the support of the second amendment.
“Where you have the most armed citizens in America, you have the lowest violent crime rate. Where you have the most gun control, you have the highest crime rate.” was stated by famous musician Ted Nugent. When it comes to controversial topics in the U.S. Gun Control, it is always a topic that is discussed about. So which side should someone take?
Gun Control: “the set of laws or policies that regulate the manufacture, sale, transfer, possession, modification, or use of firearms by civilians-Wikipedia. Gun control is a very divisive issue in the United States today. It has been an issue for years, but with the recent mass shootings gun control is being brought to the country’s attention. There are many opinions in the debate on gun control. Both sides are very passionate, and have many reasons why they believe their opinions are correct.
The Second Amendment of the constitution states that as an American citizen, you have the right to bear arms. While this has been one of our rights for hundred of years, some believe that this amendment causes more issues and violence. Mass shootings generally trigger the gun control debate. As the two opposing opinions disagree, along with the pro-gun right party is the National Rifle Association(NRA). On the opposing side is a group of lobbyists that have called themselves the Brady Campaign but have changed their name along the way, adding various other gun restriction advocates.
