The definition for fair use is a legal doctrine that portions of copyrighted materials may be used without permission of the copyright owner provided the use is fair and reasonable, does not substantially impair the value of the materials, and does not curtail the profits reasonably expected by the owner. But in this case professor Faden did not copyright, it was fair use because he either got permission to use it or they did not have a copyright on it so he used it to make a informational video.But if they had a copyright law on them then he used it without permission to make video then he could get in a lot of trouble with the law and the copyright owner. So if he would have not got the right to distribute that video he would have got a fine or other consequences that are a lot worse than a fine just because he used it without permission, but if the copyright expired and he used it once it expired and the original owner did not renew the copyright it would be counted as fair use since there is pretty much no copyright on it because the owner forgot to renew it someone else is allowed to make money off of their work. If Walt Disney told professor faden that he could not use it and he used it anyway to make money or distribute it then he would be in a lot of trouble because he asked and they said no but he still used it anyway, but good thing that is not the case for this one because this case is fair use because he asked them if he could use all of the videos and they said yes he could and he used them to make an informational video for people to understand what the difference of fair use and plagiarism.
