1. Explain the legislative framework for health, safety and risk management in the work setting. Presious healthcare provides home care to service users in their home, we work alongside other professionals to promote the service user’s wellbeing. As a manager of domiciliary care, we work in the service users home environment, we work within several laws and legislations such as: Food Hygiene Regulations 2006, Care Standards Act, Health and Safety 1974, Disability Act 1989 etc. The Health and Safety at work Act 1974 (HASAW) is the primary piece of Legislation responsible for enforcing acts that’s relevant to the working environment. An act of parliament is the primary legislation of the UK, the law. The act is passed by parliament. A regulation is a rule that’s written and sets out the ways the act will be enforced. In our company we have a designated Health and Safety representative who must take responsibility to monitor, record and report, these include risk assessments. Risk assessments are completed regarding the work we do, the environment where we work and the equipment we use. Then maintain records, stating who’s responsible for the task and ensure they are being carried out effectively. The assessment should be dated, including a review date and signature of all involved in the assessment, risk assessments are completed for activities and measurement put in place to minimise the risks. Ensure that the service user is at the centre (person centred approach) of all the decisions on how they choose to live their lives and ensuring they are aware of the risks they wish to take. Analyse how policies, procedures and practices in your own setting meet health, safety and risk management requirements. Presious Healthcare have policies and procedure in their organisation which protects the service users and staff. We receive regular updates regarding changes that are reviewed to support the standards of legislation and comply with CQC regulations and recommendations. Staff are informed of any changes make to policies and procedures and given regular training to update their knowledge. Doing so enables us to do a have a better outlook on the job of caring for the service users and to maintain their safety. The Care Quality Commission(CQC) was established in 2009 to help maintain and regulate services that work in Health and social care establishments.
