Recommendations With the recent repeal of net neutrality laws, there are two major concerns regarding these new regulations guidelines that should be addressed. First, how will the FCC regulate ISP's using its existing powers? Specifically, how will the FCC review, monitor, and supervise the activities of ISP's without overstepping their ancillary jurisdiction? More importantly, will ISP's be allowed to dictate what content and information is accessible? Considering that the FCC has an obligation to encourage the development of innovative services and protect consumers, the recent change to these laws has already opened the door to litigation. In general, the laws regarding net neutrality are in place to provide open access to consumers, to encourage continual growth and expansion of the online world. Generally, net neutrality laws force internet service providers (ISP) to treat all websites and data the same. With recent regulatory policy changes, however net neutrality and nondiscrimination protections will be abolished, and ISP's will be able to take advantage of some of these changes in policies. There are two notable court decisions regarding net neutrality. These include: Comcast Corp v Federal Communications Commission (2010); and Verizon Communications Inc. v. Federal Communications Commission (2014). Both of these disputes were similar in the sense that the FCC's actions were considered to be an overstep of ancillary jurisdiction.
