The proposed gun control laws are superfluous and detrimental to society. These laws are in violation of the second amendment, are negated by the black market, and tend to raise crime rates. While senators have good intentions by passing the stricter laws the unconsidered negative consequences may outweigh the positive ones. The Constitution is the foundation of any law that has been passed since the documents creation. Therefore, any law that contradicts the constitution should not be ratified by any state and if one is ratified, the law should be challenged by the Supreme Court. The Constitution states, in the second amendment, that “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed” (Cornell University). The Second Amendment specifically gives all citizens the right to keep and bear arms. Those who favor gun control argue that the constitution states that a militia is necessary; a militia is defined as a civilian population to supplement the army in an emergency. It would also take guns away from the citizens who do not break the law to begin with. The only people who would have guns are those who break the law and those who enforce the law. The National Institute of Justice did a study that found that 13% of all people arrested admitted that they had acquired a gun illegally, 56% of those who admitted getting a gun paid cash for them, and only 5% of those who admitted to getting a gun stole the fire arm from another person’s home. A criminal who is going to break a law will not be stopped by placing a gun ban as they will just break that law too.
