After all the abuse at Winterbourne View came to light and after the investigation, the was a document published called “Winterbourne View – Time for Change” with the sub heading of “Transforming the commissioning of services for people with Learning Disabilities and/or Autism” this document was written in 2014. The report made several recommendations: • The Government should respond to ‘the Bradley Report Five Years On’,5 to ensure that people with learning disabilities and/or autism are better treated by the criminal justice system. • People with learning disabilities and/or autism and their families should be given a ‘right to challenge’ decisions to admit or continue keeping them in inpatient care. The funding and responsibility for commissioning services for this group should be devolved as much as possible from NHS specialised commissioning to Clinical Commissioning Groups. Learning from the strengths (and weaknesses) of the Better Care Fund, a mandatory framework should then require the pooling of health, social care and housing budgets, and mandate NHS and local government commissioners to draw up a long-term plan for spending that funding in a way that builds up community services, makes the Charter of Rights above real, and reduces reliance on inpatient services.
